Controlled Drug Legislation – Brexit

The Department of Health and Social Care has issued the following guidance on the treatment of controlled drugs from 1 January 2021.

  • Controlled drugs are controlled in the UK under the Misuse of Drugs Act 1971 (‘the 1971 Act’) and the Misuse of Drugs Regulations 2001 (‘the 2001 Regulations’). This is UK legislation, and will not be altered at the end of the transition period.
  • From 1st January 2021, following the end of the transition period, Home Office controlled drug import-export licensing requirements for trade in controlled drugs within the UK will not change.
  • From 1st January 2021, Home Office controlled drug import-export licensing requirements for trade in controlled drugs from the UK, including from Northern Ireland (NI), to the EU, and vice versa, will not change.
